Summary

VIOLATIONS: The Respondent' tank battery facility was a point source discharge of pollutants, specifically brine, to the receiving waters of a tributary of Montezuma Creek, located in the Southwest Quarter of Section 34, Township 12, North, Range 12East, Okmulgee County, Oklahoma. The discharge of brine was documented during an August 5, 2003, inspection. RELIEF: The Order specifies that the Respondent should take steps to cease all discharges of pollutants and to neutralize the brine contaminated area south of the tank battery by applying soil amendments to neutralize the sodium chloride. Additionally, the Order asks the Respondent to consider: (1)constructing adequate secondary containment; (2)installing a sump pump to remove and re-circulate standing fluids from the secondary containment to the tank; and (3)installing an alarm system in the saltwater tank to prevent additional overflows. A follow-up inspection will determine the extend of compliance with the Order.
