On September 30, 2003, Goddard Enterprises, Inc. of Moundsville, WV agreed to pay a civil penalty of $9,200.00. Goddard Enterprises, Inc. is the owner and/or operator of underground storage tanks (AUST=s@) located at 901 Lafayette Avenue, Moundsville, West Virginia (AFacility@). They have since come into compliance.
On September 30, 2003, the United States Environmental Protection Agency - Region III issued Consent Agreement and Final Order (ACAFO@) which, pursuant to 40 C.F.R. '' 22.13(b)(2) and (3), simultaneously commenced and concluded a proceeding for alleged violations of the West Virginia UST program and Section 9006 of the Resource Conservation and Recovery Act by Goddard Enterprises, Inc. The CAFO alleged, inter alia, that Goddard Enterprises, Inc. failed to maintain and operate corrosion protection for the UST system=s pumps, and failed to perform release detection for the USTs it's Facility
