This is an Administrative Complaint pursuant to the Clean Air Act / Asbestos NESHAP and TSCA ASHARA issued to Francis Lennon d/b/a Mulligan�s Irish Pub & Restaurant; Thakor P. Patel & Mira T. Patel d/b/a Super 8 Motel, South Lake Tahoe; & Ray Rhodes d/b/a Maintenance Plus. The violation involves the failure to provide written notice of intention to renovate, 40 CFR 61.145(b); failure to keep RACM adequately wet, 40 CFR 61.145(c)(6); discharge of visible emissions of asbestos-containing waste material, 40 C.F.R. 61.150(a); failure to properly dispose of asbestos-containing waste material, 40 CFR 61.150(b); failure to maintain waste shipment records, 40 CFR 61.150(d); and conduct of response action without accreditation, 15 USC 206(a). The Complaint seeks a penalty of $66,300 under the CAA and $5000 under TSCA.
