This is a Administrative Penalty action in which an initial complaint has been filed along with a Proposed Consent Agreement/ Final Order (CA/FO) pursuant to CWA Section 309(g). The respondent is J.E. McAmis, Inc., of Chico, California. The violation involves the unauthorized discharge of over-dredged material into San Francisco Bay, and the mis-dumping of other permitted dredged material outside the designated SF-11 disposal site in San Francisco Bay, on numerous occasions between August and November, 2001. These discharges occurred while McAmis was conducting maintenance dredging of the Larkspur Ferry Channel, under contract to the San Francisco District, U.S. Army Corps of Engineers. The CA/FO establishes that McAmis will pay a $70,000 Class 2 Administrative Penalty. Public Notice of the CA/FO was published in the Federal Register on September 11, 2003.
