Summary

Flat Rock Energy Company VIOLATIONS: The Respondent's tank battery facility was a point source discharge of pollutants, specifically brine, to the receiving waters of a tributary of Mud Creek, located in the Northeast Quarter of Section 22, Township 21 North, Range 10 East, Osage County, Oklahoma. The discharge of brine was documented during an October 2, 2003 inspection. RELIEF: The Order specifies that the Respondent immediately take steps to cease all discharges of pollutants; construct a ?flush and vac? cleanup system to remove contaminants from the flow path; and to neutralize the brine contaminated area down gradient of the tank battery by applying soil amendments to neutralize the soils. Additionally, the Order asks the Respondent to consider (1) constructing adequate secondary containment: (2) installing a sump pump to remove and re-circulate standing fluids from the secondary containment to the tank; (3) repair or replace leaking equipment; and (4) up-date the existing lease sign to reflect the current operator. A follow-up inspection will determine the extent of compliance with the Order.
