A storm water compliance inspection was conducted by EPA on February 19, 2004, to evaluate compliance with the Texas General Permit for Construction Activities at The Legends On Lake LBJ construction site. It was determined that the operator, The Legends On Lake LBJ, Ltd., had not re-applied for permit coverage when the Texas Commission on Environmental Quality (TCEQ) issued the General Permit on March 5, 2003. There was no Storm Water Pollution Prevention Plan (SWPPP) on site for review. It was determined that while there were violations, The Legends On Lake LBJ, Ltd., qualified for the Expedited Settlement Offer, which was drafted.
