The Respondent discharged fill material into waters of the United States without a CWA Section 404 permit. The impacts were approximately 120 acres of bottomland hardwood wetlands. A settlement agreement between EPA and legal representation for Mr. Palermo has been reached to include the payment of a Class I administrative penalty, restoration and reforestation, and application of an After-the-Fact Permit with the New Orleans District Army Corps of Engineers.
