Respondent is operating a water treatment plant in the State of New Mexico and was inspected by NMED on February 26, 2004. The water treatment plant has a backwash filter that discharges into the Animas River. Respondent has been discharging pollutants to this river without a Clean Water Act NPDES permit since the late 1970's. EPA is ordering the Respondent to obtain an NPDES permit and comply with the permit requirements.
