Respondent is an operator at a residential construction project in Rio Rancho, New Mexico. Respondent had discharges of pollutants in their storm water discharges to waters of the U.S. Respondent was inspected on March 11, 2004, and found to be in violations of the NPDES storm water construction general permitting program by failing to have an NPDES permit. Respondent was Ordered to obtain a permit and comply with the terms and conditions of the permit. Respondent has signed and certified that they are in compliance and is settling these alleged violations.
