Respondent is an operator at the commercial construction project (hospital). Respondent had discharges of pollutants in its storm water discharges to waters of the U.S. Respondent was inspected on March 7, 2004, and found to be in violations of the NPDES storm water construction general permitting program by failing to have an NPDES permit, failing to have prepared a Storm Water Pollution Prevention Plan, and failing to have properly implemented Best Management Practices. Respondent has certified that it has come into compliance since the inspection and is agreeing to settle the alleged violations.
