Respondent is an operator at the commercial construction project known as the St. Michael's Office Park. Respondent had discharges of pollutants in its storm water discharges to waters of the U.S. Respondent was inspected on March 12, 2004, and found to be in violations of the NPDES storm water construction general permitting program by failing to have an NPDES permit for the entire time of construction, failing to have signed and certified a Storm Water Pollution Prevention Plan, failing to have a qualified inspector, failing to post a construction sign, and failing to have properly implemented some Best Management Practices. Respondent has certified that it has come into compliance since the inspection and is agreeing to settle the alleged violations.
