This order is an Agreement and Covenant Not to Sue between EPA and John Parker, Navajo Development LLC, Navajo Development Company, Inc., and the Mineral County Fairgrounds Association. This Agreement addresses 297.73 acres in Creede, Colorado. The Site historically has received runoff from upgradient mining properties, and with this runoff, have come elevated levels of arsenic, lead, cadmium and zinc. Voluntary clean-up of the property will be performed by John Parker and the Mineral County Fairgrounds Association under two approved plans from the State of Colorado's voluntary clean-up program.
