CAFO issued 9/14/2004, assessing a penalty of $10,562.50 for the CERCLA violation, and $10,562.50 for the EPCRA violations. Respondent failed to immeditely notify the NRC as soon as Respondent had knowledge of the release of anhydrous ammonia in an mount equal to or greater than its RQ at Respondent facility. In violation of CERCLA Section 103(a). Respondent should had immediately notified the SERC and the LEPC of said release of anydrous ammonia immediately after it had knowledge that the RQ of anhydrous ammonia was released.
