Summary

On September 17, 2004, an Administrative Order on Consent was filed under Section 3013 of the Resource Conservation and Recovery Act (RCRA). Hazardous constituents associated with wood preserving activities were detected in the past in the soil and groundwater beneath the Mixon Brothers Wood Preserving facility. The U.S. Environmental Protection Agency (EPA) has been tasked to certify, under the Government Performance and Results Act (GPRA), that human exposure to hazardous constituents and groundwater migration of hazardous constituents have been controlled at numerous sites. Mixon Brothers Wood Preserving is one of the sites on the GPRA list. The Order requires the Mixon Brothers facility to implement a sampling and analysis plan to characterize the nature and extent of soil and groundwater contamination.
