EBS Associates LLC, dba Elvree Farm in Slate Hill, NY is a permitted medium CAFO. The facility is in noncompliance with terms of the NYSDEC CAFO General Permit (GP-04-02). Specifically, facility failed to properly operate and maintain the mortality compost Best Management Practice in accordance with 40 CFR 122.42(f)(ii) and Part X. Section G of GP-04-02. In addition, the facility failed to maintain records as required in accordance with 40 CFR 122.42(e)(2) and Part VII, Section C.vii of GP-04-02. Facility is required to evaluate the compost area in accordance with applicable NRCS standards and guidelines and maintain all records as required.
