The CD addresses Defendants' violations at 3 sites of CWA Sections 301(a) and 402(p), 33 U.S.C. 1311(a), and 1342(p), regulations promulgated thereunder, and terms and conditions of the Federal Construction General Permit (Federal CGP) issued pursuant to Section 402 of the Act, 33 U.S.C. 1342, for the discharge of stormwater pollutants from construction sites into waters of the United States.
The CD provides for the payment of a civil penalty of $500,000, and the development and implementation of compliance measures with an approximate cost of $92,000 that will provide increased oversight of their construction operations ensuring greater compliance with stormwater requirements at its current and future construction sites. This includes hiring a Company Stormwater Compliance Manager who will oversee the compliance program and be responsible for compliance at all sites, hiring a Compliance Manager who will oversee stormwater compliance at each construction site, and providing training to all employees with construction operational and environmental compliance responsibilities.
