This is an Administrative Penalty action pursuant to EPCRA 313 issued to Cypress Semiconductor Coporation. The Violation involves failure to file timely Toxic Chemical Release Inventory Reporting Forms required under EPCRA 313 for hydrogen fluoride for the calendar years 2004 and 2005. These violations were voluntarily disclosed to the Agency. Cypress did not quality for the Audit Policy on both counts but did qualify for 100% mitigation for the 2004 violation, and then received a 50% penalty mitigation under the Enforcement Response Policy for the 2005 violation.
