This is an administrative penalty action sursuant to Section 312 of EPCRA. The Company audited 90 facilities nationally and disclosed EPCRA 312 violations at 15 of the facilities. The disclosure was made to EPA HQ. The case was referred to Region 9 in March 2008. EPA determined that 12 of the facilities were eligible for penalty mitigation under the audit policy.
