This Penalty Complaint and Notice of Opportunity for Hearing is issued to Goldmark Development Corporation and INREIT Properties for failure to apply for and obtain coverage either under the 1999 or 2004 permits for discharges from construction activities, and for discharging storm water into the Red River via the City of Grand Forks' MS4 without authorization.
