Violation: The Respondent's tank battery facility was a point source discharge of a pollutant to waters of the US. The facility was inspected by an EPA inspector on February 10, 2009, which the inspector observed the facility had discharged brine to a tributary of Beaver Creek.
Relief: An Administrative Order is being issued to the Respondent requiring the following: cease all discharges of pollutants from the facility; remove all the brine in-between the facility and the point of entry; remove all the brine from the impacted water body; and submit written certification.
