The U.S. EPA Region 9 and the Arizona Department of Environmental Quality are settling with Fleming Companies, Inc., an entity currently under Chapter 11 bankruptcy protection, to remove two USTs that were improperly abandoned. The agreement directs the respondent to properly close the USTs by removing them from the ground and to remediate any contamination that is discovered at the site up to a cost of $150,000.
