Respondent is a Sand/Gravel/Concrete/Asphalt plant that was inspected by EPA on March 30, 2005. EPA found that the facility failed to have NPDES storm water permit coverage as an Industrial Activity (40 CFR 122.26(b)(14)(iii)) for discharges to the Rio Grande. EPA is Ordering the Respondent to obtain coverage and come into compliance with the permit.
