This Administrative Compliance Order, pursuant to section 309(a) of the CWA, was issued to Clean Harbors Environmental Services due to findings made during EPA's inspection of the Facility on January 12, 2004. This Order was issued due to Clean Harbors failure to comply with an EPA Information Request, issued under Section 308 of the CWA and Federal categorical pretreatment standards at 40 CFR 403 and 437. Specifically, Clean Harbors is in violation of the CWA because EPA finds that the facility submitted incomplete and inconsistent information pursuant to a 308 Information Request; discharged wastewater in exceedance of the federal titanium standards; diluted wastewater as a substitute for treatment; conducted inadequate sampling; did not follow reporting requirments, and has not demonstrated that it provides adequate treatment for all wastes and wastewater received on-site. The Order directs Clean Harbors to submit a preliminary engineering plan verifying that all wastes are treated and sampled in compliance with federal regulations, cease dilution as a substitute for treatment, and submit monitoring results taken of the Facility's wastewater discharges for one year to verify that they have come into compliance with the pretreatment standards at 40 CFR 437.
