Summary

Late Reporter Initiative: The Toxic Release Inventory Envirofacts Database indicates that Anheuser-Busch Inc., submitted late Toxic Release Inventory Form R reports for sodum nitrite for Reporting Years 199, 2000, 2001 and 2002 on January 8, 2004. These failures to submit Form R reports, in a timely manner, constitute violations of Section 313 of the Emergency Planning and Community Right-to-Know-Act, 42 U.S.C. � 11023, and with 40 C.F.R. � 372.30. Since the facility has had a previous violation, the penalty for the 1999-2002 late reporting violations could have been further adjusted upward by 25% as per the EPA Enforcement Response Policy, resulting in a penalty of $86,248. This is a combined administrative civil complaint and consent agreement final order action with a penalty of $17,250.
