This is a resolution of a voluntary disclosure by means of an administrative penalty action issued to Pride of San Juan, Inc. pursuant to EPCRA and CAA. The violation involves failure to sumit a risk management plan, MSDS information and annual chemical inventory information for its Yuma, Arizona facility. Pride of San Juan operates a refrigeration plant that uses anhydrous ammonia in its chilling operations. During an environmental audit of its operations, Pride of San Juan discovered violations of CAA Section 112(r)(7) and EPCRA Sections 311 and 312. After discovering its violations, Pride of San Juan promptly disclosed its violations to EPA. This enforcement action was based on the voluntary self-disclosure by Respondent, and resolved by a CA/FO initiating and resolving the violations pursuant to 40 CFR Sections 22.13 and 22.18. Application of the Audit Policy resulted in 100% penalty mitigation (zero dollars).
