U.S. EPA FILES AN ADMINISTRATIVE COMPLAINT AND COMPLIANCE ORDER WITH CREST INDUSTRIES LTD., NEW LENOX, ILLINOIS
On September 30, 2005, the United States Environmental Protection Agency Region 5 (EPA) filed an Administrative Complaint and Compliance Order (Complaint) against Crest Industries Ltd. (Crest) for violations of the State of Illinois hazardous waste regulations at its installation located in New Lenox, Illinois. EPA observed violations during a compliance evaluation and investigation at Crest in January 2004. The Complaint, which was filed under the authority of the Resource, Conservation and Recovery Act, cites violations in areas including personnel training and recordkeeping, contingency plan, tank systems and air emissions from tanks requirements, and operating without a hazardous waste permit. The Complaint seeks specific injunctive relief as well as a civil monetary penalty up to the statutory maximum as stated at RCRA ý 3008(a)(3) subject to the receipt and evaluation of additional financial information from Crest.
