Summary

This is an Administrative Order on Consent (AOC) for injunctive relief pursuant to CWA 404 for violations at the Vistas Subdivision construction site in Redding, CA. The Order directs Terra Nova Development to fund stream restoration activities on Sulphur Creek immediately downstream of the violator's impacts. Terra Nova will provide $180,937 to a local environmental organization, the Sacramento Watersheds Action Group (SWAG), to improve fish habitat, address erosion, and manage invasive species on the Creek. In a Memorandum of Agreement (MOA) between Terra Nova and the SWAG, the parties establish that funds will be used for specific tasks outlined in the AOC, and the AOC itself directs the funds to default to a mitigation bank in the event the stream restoration is unsuccessful. In addition to monitoring requirements for the project, the Order also directs Terra Nova to come into compliance with CWA by applying for an after-the-fact 404 permit from the U.S. Army Corps of Engineers.
