This is an Administrative Penalty Action pursuant to EPCRA Section 313 issued to Essilor Laboratories of America (dba Elite Optical) (David Milan, Vice-President and General Counsel) for failure to file a timely Toxic Release Inventory Reporting Form for lead in reporting year 2002. Essilor self-disclosed this omission and in accordance with the Self-Audit Policy, EPA granted the Respondent a 100% reduction of the calculated $5,500 penalty since the Respondent met all of the criteria necessary to merit such a reduction. The penalty is reduced to zero dollars ($0).
