Asarco is attempting to reorganize under Chapter 11 of the Bankruptcy Code. This action seeks to recover monies owed to EPA pursuant to section 107 of CERCLA. CERCLA requires Asarco to reimburse EPA for response costs it incurs at the Bunker Hill Mining and Metallurgical Complex Superfund site, the Jack Waite Mine, and the Commencement Bay/Nearshore-Tideflats Superfund site.
