This is an Administrative Penalty action pursuant to RCRA and 40 CFR Part 280.31(b)(1) utilizing an expedited settlement procedure. The Respondent in this action is the Navajo Housing Authority. The violation involves failure to ensure that cathodic protection on underground storage tanks is adequate and is tested every three years. The Order directs Respondent to undertake adequate corrosion protection, however Respondent has indicated that a decision was made to remove the fuel from the tanks and place the tanks in temporary closure status. The settlement establishes a penalty in the amount of $450.
