Respondent is a municipality, incorporated under the laws of the State of New Mexico, and operates a municipal wastewater treatment facility which is located in Sandoval County, and as such, is a Permittee; subject to regulations of the Clean Water Act (CWA), National Pollutant Discharge Elimination System (NPDES) Regulations. As such, the Respondent is in violation of the CWA and its NPDES permit and is being offered a Consent Agreement and Final Order for settlement of the associated penalties.
