Region III forwarded a Referral requesting that the Department of Justice (DOJ) file a proof of claim in a Chapter 11 bankruptcy action filed by CDG Technology, Inc. in the United States Bankruptcy Court for the Southern District of New York. The claim arises from a February 11, 2009 Consent Agreement and Final Order which resolved EPAÂs civil penalty claims for FIFRA violations alleged in a March 27, 2008 Complaint and Notice of Opportunity to Request a Hearing. EPA seeks to recover the administrative penalty of thirty two thousand seven hundred dollars ($32,700) assessed against CDG Technology, Inc. in connection with the February 11, 2009 Consent Agreement and Final Order.
