The dismantling of a former chemical manufacturing facility in Gibbstown, New Jersey resulted in the distribution of asbestos-containing material around the facility?s grounds, which the Defendant later spent over $1 million to clean up. EPA sued the Defendant in the Fall of 2012, seeking to recover civil penalties for alleged violations of the CAA regulations that apply to the renovation and demolition of asbestos-containing facilities. The entered stipulation resolves the litigation and requires the Defendant to pay a civil penalty. EPA is continuing to seek penalties from one of the other entities involved in the dismantling efforts.
