EPA performed a non time-critical removal action at the Crumb Trailer Park Superfund Site, Herkimer County, New York to address soils that were contaminated with lead and manganese. The Site includes a 2.6-acre parcel of real property that had been developed with a 15-unit mobile home facility acquired by the settling party in 2004. The response action included the placement of a demarcation barrier over contaminated existing soils and a one-foot soil cover over the demarcation barrier, the imposition of institutional controls to prohibit residential use of the existing mobile home location, and the relocation, pursuant to the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (URA) of those families who lived at the mobile home facility at the Site, to another mobile home facility on adjacent property owned by the settling party.
The site owner demonstrated to EPA that it had a very limited ability to pay and, based on that limited ability to pay, which requires the settling party to continue to rent to the relocated residents for 42-months at the existing below-market rents, thus defraying potential URA claims against EPA, to impose institutional controls on the Site property restricting future use and to perform specified activities to maintain the engineering controls at the Site.
