Summary

Toy’s Scrap and Salvage Corporation (“Toy’s”) in Eau Claire, Wisconsin is a small scrapyard subject to the safe disposal requirements found at 40 C.F.R. 82.156(f). Toy’s has violated the final disposal requirements for appliances containing ozone-depleting substances. Toy’s received small appliances and motor vehicles without a verification statement or an equivalent contract. It claimed that a third party is responsible for recovery of the refrigerant but did not provide a contract or verification statement with the entity. The enforcement action requires Toy’s to comply with the recovery and verification requirements of the regulations. It also requires Toy’s to reject shipments of small appliances if: a. the refrigerant lines are cut; and b. the peddler claims the refrigerant has leaked or that he has recovered the refrigerant. Toy’s has developed a contract with the third party which recovers the refrigerant from its scrap at the facility. It has also agreed to use verification statements for units which have already had its refrigerant recovered prior to delivery.
