This is a civil action in the District Court of the Northern District of New York, pursuant to 42 U.S.C. 6991(e), against three related corporations. This civil action would seek civil penalties for violations of a number of regulatory requirements applicable to underground storage tanks (USTs) at eight gasoline service stations owned and/or operated by the defendants in New York State. Violations include: 1) failures to perform release detection for tanks; 2) failures to perform release detection for pressurized pipes; 3) failures to have required equipment to ensure petroleum tanks are not overfilled; and 4) a failure to have an automatic line leak detector for pressurized pipes.
