The U.S. Environmental Protection Agency, Region 5, recently filed a complaint under the Clean Air Act, in the matter of American Municipal Power - Richard H. Gorsuch Station, (AMP) in Marietta, Ohio. On March 27, 2009, EPA issued a Finding of Violation to AMP for NSR violations alleging two series of capital projects, comprising a Boiler Repair/Replacement Program undertaken between 1981 and 1987, and a Station Improvement and Uprate Program undertaken between 1988 and 1991, constituting major modifications resulting in significant net increases in emissions. Per the Consent Decree, American Municipal Power will pay a penalty of $850,000, implement an Energy Efficiency Program to provide energy efficiency services to its member municipalities, and permanently retire the Gorsuch Station as a coal-fired, steam and electric power generating plant by December 31, 2012, with interim emission reductions.
