Summary

U.S. Environmental Protection Agency (EPA) issued a Notice of Violation to A&A Manufacturing Company, Inc. (A&A) on December 22, 2008 for violating the Wisconsin State Implementation Plan (SIP) regulation Chapter NR 407.08 and 40 C.F.R. § 70.5. Specifically, A&A operated its Gortiflex process without applying for a Title V operating permit. A&A had annual emissions of toluene, a hazardous air pollutant, greater than 10 tons. A&A applied for a Title V operating permit on June 25, 2008. The Wisconsin Department of Natural Resources must issue the Title V operating permit before A&A is in compliance with the Wisconsin SIP and 40 C.F.R. § 70.5. A&A has agreed to a supplemental environmental project (SEP), spending $22,280 dollars to reformulate two coatings, reducing toluene and volatile organic compound emissions. In conjunction with the SEP, this Consent Agreement for the amount of $79,429 resolves the matter.
