This is an Administrative Penalty action pursuant to EPCRA 313 issued to Hogan Manufacturing, Inc. The violation involves failure to file timely Toxic Chemical Release Inventory Forms required under Section 313 for Chromium processed in 2004, 2005, and 2006 at the S. McHenry Street facility; and for Nickel and Chromium processed in 2004, 2005, and 2006 at the Coley Street facility. The Respondent self-disclosed this omission on 5/21/2008. Pursuant to the EPA Audit Policy the Respondent met the criteria for 75% mitigation of the penalty. Accordingly, the CAFO establishes a penalty of thriety-four thousand fifty dollars ($34,050).
