Summary

This case addresses violations of the Safe Drinking Water Act's Underground Injection Control regulations by Kula Lodge and Restaurant in Maui. EPA's regulations banned the use of large capacity cesspools after April 2005. A large-capacity cesspool is one that discharges untreated sewage from multiple dwellings, or from a non-residential location that serves 20 or more people per day. Kula Lodge & Restaurant owner Fred Romanchak agreed to pay a fine of $51,000 for failing to close the large capacity cesspools at his facility, and completed installation of a new state-approved wastewater system.
