The proposed enforcement action is for alleged violations occurring during Cashman's dredging of the Porter and Crane Rivers in Danvers, Massachusetts pursuant to a MPRSA permit issued to the Town of Danvers by the U.S. Army Corps. EPA is seeking administrative penalties pursuant to MPRSA 105 for two violations: (a) discharging dredged material in an area not authorized by the Corps permit (Beverly Harbor), in violation of MPRSA 101(a); and (b) transporting unauthorized dredged material (from the Porter River) for the purpose of dumping it into ocean waters, in violation of MPRSA 101(a).
