On November 17, 2010, Region I filed a consent agreement and final order resolving American Science & Engineering, Inc.'s (AS&E) civil administrative penalty liability for stormwater violations at the company's X-ray apparatus manufacturing plant in Billerica, Massachusetts. AS&E discharged stormwater associated with industrial activity without a permit and failed to apply for coverage under the Multi-Sector General Permit applicable to discharges of storm water associated with industrial activity, for a period of at least five years. AS&E disclosed the violations to Region I, but the Region determined that AS&E did not meet the relevant criteria of EPAÂs self disclosure policy. The company has agreed to pay a $40,000 penalty to resolve the violations.
