This is a CERCLA §109 penalty action for Respondent's failure to promptly notify the NRC of its March 23, 2008 release of phosphoric acid above the reportable quantity (RQ) as set out at CERCLA 104. A CAFO has been negotiated/signed and entered which requires Respondent to pay civil penalties in the amount of $12000.
