Decorative Panels Inc. (DPI) located in Alpena, Michigan was found to be emitting opacity from its boilers in excess of the 20 percent opacity limit found in its Title V permit and the Michigan State Implementation Plan (SIP). The opacity was recorded from DPI's continuous opacity monitor (COM), and the violations were reported in DPI's excess emission quarterly reports for the years 2004 and 2005. On September 11, 2006, EPA issued a Notice of Violation/Finding of Violation (NOV/FOV) to DPI for those excess emissions. In 2007, DPI installed an electrostatic precipitator and Trona injection system on its boilers to reduce its opacity. As a result of the new pollution controls, DPI's opacity has been well below the 20 percent limit. DPI is considered to be in compliance with its opacity limit. Settlement was reached between EPA and DPI, and DPI agreed to pay a penalty of $85,000 for its opacity violations.
