On June 30, 2004, EPA issued a Notice of Determination (���NOD���) pursuant to the ���Final Policy Statement on Incentives for Self-Policing: Discovery, Disclosure, Correction, and Prevention of Violations���, 65 Fed. Reg. 19618 (April 11, 2000). The NOD is based on self-disclosures provided by Welch Foods, Inc. for violations of Section 312 of EPCRA, and Titles IV (Acid Deposition Control) and V (Permits) of the Clean Air Act, at its facility located at S. Lake Drive, North East, Pennsylvania.
The total gravity-based civil penalty for EPRCA violations would be $20,625.00 and the total gravity based civil penalty for CAA would be $119,000.00. However, because Welch Foods satisfied all of the conditions of EPA���s Self-Disclosure Policy and the amount of economic benefit gained is insignificant, EPA waived the civil penalty for the disclosed violations.
