U.S. Environmental Protection Agency (U.S. EPA) Region 5 issued a Consent Agreement and Final Order (CAFO) under the Clean Air Act to Du-Kane Asphalt (Du-Kane) for their facility located at 600 S. Lombard Road, Addison, Illinois. U.S. EPA issued the CAFO to resolve the Finding of Violation (FOV) issued to Du-Kane on December 12, 2005 for non-compliance with the New Source Performance Standards (NSPS) General Provisions and NSPS Standards of Performance for Hot Mix Asphalt Facilities. Du-Kane was cited because their baghouse exceeded the 20 percent opacity standard. Du-Kane was also cited for not maintaining and operating their air pollution control equipment in a manner consistent with good air pollution control practice. Per the CAFO, Du-Kane will pay a penalty of $11,000. A Supplemental Environmental Project (SEP) will not be implemented. An Administrative Consent Order (ACO) was issued concurrently to the CAFO.
