This is a judicial referral asking the Department of Justice to initiate a civil enforcement action against Rhodia Inc. for alleged violations of the Clean Air Act at its sulfuric acid plants in Carson and Martinez, California. Originating from a Region 5 investigation, this action developed into a national enforcement case involving EPA Headquarters; Regions 5, 6, and 9; and several state and local agencies. The case against Rhodia includes the following requirements of the Clean Air Act pertaining to sulfur dioxide and sulfuric acid mist emissions: new source review and prevention of significant deterioration requirements, and new source performance standards for sulfuric acid plants codified at 40 C.F.R. Part 60, Subpart H.
