Summary

On April 26, 2011, Region 10 filed a Consent Agreement and Final Order (CAFO) resolving TSCA claims against Cha Special Painting (Cha Painting) of Milwaukie, Oregon. This CAFO resolves Region 10’s claim that Cha Painting violated the requirements of the Lead-Based Paint Pre-Renovation Education Rule. Specifically, Region 10 alleged that Cha Painting failed to provide EPA’s lead hazard information pamphlet (Renovate Right) to two property owners, prior to conducting renovations at their respective properties. The renovations took place at properties in Portland, and Aloha, Oregon. In consideration of the Respondent’s ability to pay claim, EPA determined that an appropriate civil penalty to settle this action is $500. It also should be noted that the target housing units are located in potential environmental justice areas in Oregon.
