Administrative Complaint was issued to facility for alleged RCRA violation January 21, 2011 with proposed penalty for violations. The facility was in violation of failing to conduct repairs in accordance with a code of practive developed by a nationally recognized association or an independent test laboratory. Oklahoma Administrative Code #165:25-5-2(1) (40 C.F.R. #280.21(b)280.33) requires that a tank upgrade with interior lining must be conducted as stated above. Respondent was in violation from August 8, 1998 till August 7, 2008. Penalty was agreed to and paid in full November 15, 2011. Case closed.
