Respondents, Robert M. and Nancy M. Loomis of Kilgore, Texas, have agreed in a Consent Decree and Final Order to pay a $22,500 civil penalty for claims stemming from the unauthorized filling as well as discharges of stormwater from a construction site without a NPDES permit. Accordingly, the hearing scheduled in this case has been cancelled.
